A Postnuptial Agreement (also known as a Marital Agreement) is an agreement between two persons who are already married. It describes how they will hold title to property acquired in the future, and how they will hold the property they presently own. It also sets out how their property shall be divided in the event the marriage ends. A related purpose of marital agreements is to preserve the estate of a spouse intact for his or her heirs and free from succession claims of the surviving spouse.
A postnuptial agreement is similar to a premarital agreement, but is entered into after marriage rather than before marriage. The law regarding enforcement and interpretation of postnuptial agreements differs from that of premarital agreements because of the law proscribes different duties of married persons towards each other than that of unmarried parties. While it is preferable to enter into a prenuptial agreement, a postnuptial agreement is better than no agreement at all.
