Understanding Your Bankruptcy Options
Federal bankruptcy law provides different chapters designed for specific situations.
Chapter 7 Bankruptcy: Liquidation & Discharge
Chapter 7 eliminates most unsecured debts, including credit card balances, medical bills, personal loans, and utility bills. The test determines eligibility by comparing your current monthly income to California's median family income for your household size. If your income falls below the median, you qualify for Chapter 7.
The Chapter 7 trustee examines your assets to determine if any non-exempt property should be liquidated to pay creditors. California offers two sets of bankruptcy exemptions, and you choose whichever protects more of your property. Common exemptions protect equity in your home, vehicles, household goods, retirement accounts, and tools of your trade. Most Chapter 7 debtors have no non-exempt assets and lose nothing in bankruptcy.

Unsecured creditors receive whatever remains from your disposable income after paying priority and secured claims. After completing all plan payments, the remaining unsecured debts are discharged.
